Man pleads no contest to killing 5 month old baby
ROANOKE, Va. (WSET) -- A Roanoke man has pleaded no contest to killing a 5 month old baby in his care.
Mikeal Sardarov was facing three charges in the death of Liam Fink- first degree murder, child abuse and neglect, and child endangerment.
Roanoke police say on February 28 they were called about an unresponsive baby who was in the care of Sardarov. The baby was taken to the hospital.. but died a day later.
According to the medical examiner, the 5 month old died of blunt force trauma to the head.
Assistant Commonwealth's Attorney David Billingsley says there were numerous head traumas documented- with 8 different points of impact.
He says because of that, the Commonwealth Attorney's office doesn't believe Fink was just dropped on the ground.
The plea agreement didn't including a sentencing agreement- so for the second degree murder Sardarov could spend anywhere from 5 to 40 years behind bars.
He'll be sentenced on October 26.
When asked why a plea agreement was offered when the infant's injuries were so severe, Billingsley explained that sometimes it's hard to convince a jury of 12 people that when Sardarov was hitting the child, he meant to kill it, which would have been required for the first degree murder charge.
