Lynchburg, VA - A Lynchburg grand jury also an indictment on capital murder against a Lynchburg teen.
Raheem Johnson, 17, is accused of killing Timothy Irving at the Millwoods Apartments on April 11.
Johnson's girlfriend says two masked men burst in, shouting 'give it up' before shooting Irving. The Commonwealth's Attorney's Office says Johnson can not get the death penalty, because under Virginia law, he is too young.
Johnson's co-defendant in the killing, 19-year-old Dennis Watts, Jr. has been indicted on six charges, including felony murder.
