Salem, VA - Two Roanoke County residents, convicted in the 2008 death of a construction worker, are now the focus of a $10 million civil trial.
This all taking place in Roanoke County Circuit Court more than five years after Richard Slone was killed after he was pinned between heavy equipment during a traffic accident on Electric Road.
Tracy Nininger and Jeffrey Dupree are convicted of aggravated involuntary manslaughter and driving under the influence. Both sentenced to two and a half years in prison for the accident.
They were following one another home after a night of drinking when Nininger hit a construction vehicle, in a construction zone and then Dupree hit Nininger.
The chain reaction killed Slone as he worked on the site.
Now Slone's estate is seeking $10 million - $8 million in damages from the pair as well as $2 million in punitive damages.
Nininger or Dupree were in the courtroom Wednesday as the plaintiff continues to call witnesses.
Wednesday's central testimony revolved around the man driving the tractor that was hit and forced onto Mr. Slone when he was killed.
The defense expects the trial to run through Friday.
