Liquor Ad Ban Overturned for VT, UVa School Papers
Blacksburg, VA - A federal appeals court says Virginia Tech's and UVa's newspapers can run advertisements for alcohol, despite a regulation the state says is intended to curb illegal underage drinking.
The 4th U.S. District Court of Appeals concluded the Virginia Alcoholic Beverage Control Commission ban is unconstitutional, as it applies to The Cavalier Daily and the Collegiate Times.
The court says the regulation violated the paper's First Amendment rights because it prohibits a large number of those over 21 from getting truthful information about a product they are legally allowed to drink.
The ruling reverses a lower court decision.
