Update: Bond Increased for School Nurse Linked to Murder Plot
Update: 10:00 a.m. Friday:
There was another bail hearing Friday morning for the Sontag Elementary School nurse accused of being part of a murder for hire plan
This morning, a judge increased Cathy Bennett's bond to $75,000. Thursday, in her initial bond hearing, a judge set bond at $60,000. The Commonwealth immediately appealed that, which meant that Bennett remained in jail Thursday night.
Rocky Mount, VA - The Sontag Elementary School nurse accused of being part of a murder for hire plan was granted bond Thursday afternoon but will be in jail at least one more night.
Cathy Bennett will continue to be held at the Western Virginia Regional Jail until she has a new bond hearing.
She's accused of helping a teacher at the school hire a hit man to kill her ex-husband.
It was a strange day in Franklin County's General District Court which saw a number of docket changes, a continuance and a substitute judge who had to preside over an initial bond hearing.
In fact, retired Judge Frank Greenwalt didn't even know any of the particulars in the case.
Regardless the defense argued for a bond, citing Bennett's long standing familial ties to the community, her two children and the fact that she has no criminal record.
The Commonwealth, wanting at least a $75,000 bond, immediately appealed the judge's $60,000 dollar decision, which the Commonwealth says, should keep Bennett in jail at least until her new hearing tomorrow morning.
"When you look at the prior criminal history that gives you an indication if they are going to reoffend. In this particular case we did not have that but the mere fact of what she did was so egregious you have to look at that and the danger to the community (and) that's what the Commonwealth is worried about," said Franklin County's Commonwealth's Attorney, Tim Allen.
Bennett is accused of trying to help 47 year old Angela Nolen hire a hitman to kill Nolen's ex-husband.
Nolen also worked at Sontag Elementary as a kindergarten teacher.
Nolen was scheduled to also have a bond hearing today but that hearing was continued.
She too is at Western Virginia Regional Jail.
